Terms of Sale — Belzar

These Terms of Sale, hereinafter the "Terms", apply to all orders placed on the website www.drinkbelzar.com, hereinafter the "Site", by consumers acting for non-professional purposes.

The Site is published by Ousia, a simplified joint-stock company (SAS) with capital of €14,498.00, registered with the Paris Trade and Companies Register (RCS) under SIREN number 898716964, with its registered office located at 24 rue Sibuet, 75012 Paris, hereinafter "Belzar" or the "Seller".

Any order placed on the Site implies full and complete acceptance of these Terms by the customer.


1. Purpose

These Terms define the rights and obligations of Belzar and any individual consumer, hereinafter the "Customer", wishing to purchase the products offered on the Site.

They apply without restriction or reservation to all sales concluded online on the Site.

Belzar reserves the right to modify these Terms at any time. The applicable Terms are those in force on the date the Customer's order is validated.


2. Products

Belzar offers for sale ready-to-drink non-alcoholic beverages, as well as, where applicable, gift sets, packs, limited editions, derivative products, or accessories.

The essential characteristics of the products are presented on each product page: composition, format, quantity, price, any nutritional information, storage conditions, any presence of allergens, and any other information useful to the Customer prior to purchase.

Photographs, visuals, and staged product images are provided for illustrative purposes. Belzar makes every effort to ensure a faithful representation of the products, without minor differences in presentation, color, or packaging being able to engage its liability.

Products are offered subject to available stock.


3. Price

Prices displayed on the Site are shown in euros, inclusive of all taxes, excluding any delivery charges.

Delivery charges are shown to the Customer before final validation of the order.

Belzar reserves the right to modify its prices at any time. Products are invoiced based on the rates displayed at the time the order is validated.

In the event of an obvious pricing error, Belzar reserves the right to cancel the order concerned and refund the Customer.


4. Order

The Customer may place an order directly on the Site.

Before validating their order, the Customer is invited to check the details of their cart, the products selected, quantities, total price, delivery charges, personal information, delivery address, and billing address.

The order is definitively validated when the Customer accepts these Terms and proceeds to payment.

Belzar then sends the Customer a confirmation email summarizing the essential information of the order.

Belzar reserves the right to refuse or cancel any order for legitimate reasons, in particular in the event of a prior dispute with the Customer, suspicion of fraud, an obvious error, unavailability of products, or the impossibility of delivering to the address provided.


5. Payment

Payment is made online using the payment methods offered on the Site, in particular by credit card, PayPal, or Shop Pay.

Payment is due immediately at the time of the order.

Transactions are secured by the payment providers used by the Site. Belzar does not have access to the Customer's full banking details.

The order will only be considered final once payment has been effectively validated.


6. Delivery

Products are delivered to the address provided by the Customer when placing the order.

Belzar currently delivers to mainland France / Corsica / the European Union.

Delivery times shown on the Site are provided for indicative purposes. Belzar makes every effort to ship orders as promptly as possible, subject to product availability and payment validation.

The Customer is responsible for the accuracy of the delivery information provided when placing the order. Belzar cannot be held liable for a delay or inability to deliver caused by an incomplete, incorrect, or inaccessible address.

Upon receipt of the parcel, the Customer is invited to check the condition of the products. In the event of a damaged, opened, wet, crushed, or otherwise visibly abnormal parcel, the Customer should, if possible, note this with the carrier and contact Belzar promptly with photographs of the parcel and the products concerned.


7. Transfer of risk

The risk of loss or damage to the products transfers to the Customer at the moment the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the products.

Where the Customer chooses a carrier other than those offered by Belzar, the transfer of risk occurs upon handover of the products to the carrier.


8. Right of withdrawal

In accordance with the French Consumer Code, the Customer has a period of 14 days from the day after receipt of their order to exercise their right of withdrawal, without having to justify their decision. For an order comprising several products delivered separately, the period runs from receipt of the last product.

To exercise their right of withdrawal, the Customer must notify their decision to Belzar before the 14-day period expires, by email at the following address: contact@ousiadrinks.com, or by any other clear written means expressing their intention to withdraw.

The Customer may use the standard withdrawal form appended to these Terms, but this form is not mandatory.

From June 19, 2026, e-commerce sites will also be required to allow consumers to exercise their right of withdrawal directly online via a dedicated feature. This feature should therefore be added to the Site if not already available.


9. Exceptions to the right of withdrawal

The right of withdrawal cannot be exercised for certain products, in particular where the products have been unsealed after delivery and cannot be returned for hygiene or health protection reasons.

Accordingly, for reasons of hygiene, food safety, and traceability, opened, unsealed, consumed, partially consumed, damaged, or products otherwise unfit for resale cannot be accepted for return.

Products must be returned in their original packaging, unopened, undamaged, complete, and in a condition allowing them to be resold.


10. Return procedure

Where the right of withdrawal is exercised, the Customer must return the products concerned within a period of 14 days following notification of their decision to withdraw.

Return shipping costs are the Customer's responsibility, unless otherwise indicated by Belzar or in the case of an error attributable to Belzar.

The Customer is invited to choose a return method that allows the parcel to be tracked. Belzar cannot be held liable for the loss or damage of a returned parcel.


11. Refund

In the event of a valid withdrawal, Belzar will refund the Customer for all sums paid, including the initial standard delivery charges, within 14 days of receiving the products returned or of the Customer providing proof of shipment of the products, whichever occurs first.

The refund will be made using the same payment method used for the order, unless the Customer expressly agrees to a different refund method.

Additional costs resulting from the Customer's choice of a delivery method more expensive than the standard delivery method offered by Belzar will not be refunded.

Belzar reserves the right to refuse the refund or apply a deduction if the returned products are opened, damaged, incomplete, or unfit for resale due to excessive handling by the Customer.


12. Damaged products, order errors, or incomplete parcels

In the event of a damaged, broken, missing, or non-conforming product, or an error in the order, the Customer must contact Belzar as soon as possible at the following address: contact@ousiadrinks.com, attaching:

  • the order number;
  • a description of the problem;
  • photographs of the parcel and the products concerned;
  • any other information useful for handling the request.

After verification, Belzar may offer, depending on the situation, a replacement, a refund, a credit note, or any other appropriate solution.


13. Statutory warranties

Products sold by Belzar benefit from applicable statutory warranties, in particular the statutory warranty of conformity provided for by the French Consumer Code and the warranty against hidden defects provided for by the French Civil Code.

The statutory warranty of conformity allows the Customer to obtain the bringing into conformity of the product in the event of a defect existing at the time of delivery.

The warranty against hidden defects allows the Customer to take action where the product has a hidden defect rendering it unfit for its intended purpose, or reducing that fitness for purpose to such an extent that the Customer would not have purchased it, or would have paid a lower price, had they been aware of it.

These warranties apply independently of any commercial warranty that Belzar may offer.


14. Storage and use of products

The Customer must comply with the storage and use conditions indicated on the packaging, product pages, or Belzar's communication materials.

Beverages must in particular be stored in a clean, dry place, away from excessive heat, freezing temperatures, and direct light, unless otherwise indicated.

Once opened, products must be consumed promptly and stored according to the instructions on the packaging.

Belzar cannot be held liable for any deterioration of the products resulting from unsuitable storage, misuse, prolonged storage after opening, or failure to follow the instructions provided.


15. Nutritional information, wellness, and responsible consumption

Information presented on the Site regarding the ingredients, botanicals, vitamins, minerals, or functional complexes contained in certain Belzar products is provided for informational purposes and in compliance with applicable regulations.

Belzar products are not medicines and are not a substitute for a varied and balanced diet or a healthy lifestyle.

Any information relating to wellness, the tasting experience, or the positioning of the products does not constitute a medical claim.

The Customer is invited to review the list of ingredients, nutritional information, and any allergens before consumption, particularly in the case of pregnancy, breastfeeding, medical treatment, allergy, intolerance, or a particular health condition.


16. Liability

Belzar is responsible for the proper performance of the obligations arising from the contract concluded with the Customer, under the conditions provided for by law.

However, Belzar cannot be held liable in the event of misuse of the products, failure to follow storage instructions, force majeure, an unforeseeable and insurmountable act of a third party unrelated to the contract, or incorrect information provided by the Customer.

Belzar does not guarantee that the Site will be accessible continuously, without interruption or error. Maintenance operations, updates, or technical incidents may temporarily affect access to the Site.


17. Force majeure

Belzar cannot be held liable for a delay or failure to perform its obligations in the event of force majeure, as defined by French law and applicable case law.

Events that may constitute force majeure include, without limitation: natural disasters, fires, floods, strikes, logistics blockages, shortages, pandemics, administrative decisions, major disruptions to transport networks, industrial accidents, cyberattacks, or any external, unforeseeable, and irresistible event preventing normal performance of the contract.


18. Personal data

In connection with online sales, Belzar collects and processes certain personal data of the Customer necessary for managing orders, payments, deliveries, invoices, customer service, and, where applicable, marketing communications.

The Customer has the rights provided for by applicable data protection regulations, in particular the right of access, rectification, objection, erasure, and restriction of processing.

19. Intellectual property

All elements present on the Site, including text, trademarks, logos, product names, photographs, videos, graphics, illustrations, packaging, visual elements, slogans, and editorial content, are protected by intellectual property law.

Any reproduction, representation, modification, adaptation, distribution, or exploitation, in whole or in part, without Belzar's prior written authorization, is prohibited.

The Belzar brand, its distinctive signs, and its brand universe remain the exclusive property of their respective owners.


20. Customer reviews

The Site may allow the publication of customer reviews on products.

The Customer agrees to publish reviews that are sincere, honest, and based on an actual purchasing or consumption experience.

Belzar reserves the right to moderate, refuse, or remove any review that is manifestly unlawful, abusive, defamatory, discriminatory, misleading, promotional, off-topic, or contrary to these Terms.

Where reviews are displayed on the Site, Belzar indicates, where applicable, the methods used for collecting, verifying, and publishing reviews.


21. Promotional offers and discount codes

Belzar may occasionally offer promotional offers, discount codes, private sales, bundles, or other commercial benefits.

These offers are valid subject to the conditions specified at the time of their publication: duration, products concerned, minimum purchase amount, availability, per-Customer limits, or any other applicable condition.

Unless otherwise stated, promotional offers cannot be combined with one another and cannot give rise to any cash refund.

Belzar reserves the right to modify or discontinue any promotional offer in the event of an obvious error, fraud, abuse, or exceptional circumstances.


22. Loyalty program, referrals, or customer benefits

Should Belzar introduce a loyalty, referral, or customer benefits program, the specific conditions of that program will be specified on the Site.

Belzar reserves the right to modify, suspend, or end any benefits program, subject to respect for any rights acquired by Customers where required by law.


23. Evidence and record-keeping

Computerized records kept in Belzar's systems and those of its service providers under reasonable security conditions are considered evidence of the communications, orders, payments, and transactions that have taken place between Belzar and the Customer.

Order confirmation emails, invoices, proof of payment, and delivery information may be kept in accordance with applicable legal obligations.

25. Consumer mediation

In accordance with the provisions of the French Consumer Code, the Customer has the right to use, free of charge, a consumer mediator with a view to the amicable resolution of a dispute with Belzar, after having first sent a written complaint to Belzar.

Belzar is a member of the following mediation service:

Membership in a consumer mediation scheme is mandatory for businesses concluding contracts with consumers.


26. Governing law and jurisdiction

These Terms are governed by French law.

In the event of a dispute, the Customer is invited to contact Belzar first in order to seek an amicable solution.

Failing an amicable resolution or mediation, the dispute may be brought before the competent courts in accordance with ordinary law rules.
